Privacy Policy
Effective Date: January 11, 2010

This privacy notice (the "Notice") covers the collection and use of information for this website, http://www.indyprofessionals.com (this "Website").  This Website is owned by IndyProfessionals, LLC ("us" or "we").  We reserve the right to modify this privacy statement at any time, so please review it frequently.  If we make material changes to this policy, we will notify you here or by means of a notice on our home page.  By continuing to use the IndyProfessional service after notice of changes have been published on the IndyProfessionals website, you are consenting to the changes.

About IndyProfessionals.
IndyProfessionals, LLC is a New York limited liability company with a head office in New York City, New York County, State of New York.

What information we collect and how we use it.
When you register an account to become a IndyProfessional user ("User"), we collect the following information upon registration: name, email address, name of your company, your title, website, telephone number,  business phone number, employment status and industry or profession.  This information is requested upon registration in order to deliver the services the User has requested.  Users have the option of providing additional information through their User profile.  Any information you provide at registration or in the profile section that is not personally identifiable may be used in the same manner and extent to which other information that is not personally identifiable is permitted to be used hereunder, including for the purpose of serving advertisements through the service.  Users may gain access to their information through this site and may use a password or other means of authentication to do so.  We do not sell this information to, or share it with third parties, except as described below.  We use your contact information to fulfill your request or respond to your inquiry, and may alert you to IndyProfessional reports or publications on related topics in which we think you may be interested.  You may "unsubscribe" from future mailings at any time.  In order to invite others to connect with you directly in IndyProfessionals, you may use the IndyProfessionals services to invite them if they are a User, or enter their names and email addresses.  This information will be used by IndyProfessionals to send your invitation including a message that you write. The names and email addresses of people that you invite will be used only to send your invitation and reminders.  You may also choose to manually enter or upload data about your contacts into your private "Indydex" section of the IndyProfessionals website.  All information entered there will only be viewable by you and will not be searchable by others Users.  All information that you enter or upload about your contacts will be covered by the same terms of this privacy policy as cover your own information.

Cookies.
Similar to most websites, Indy Professionals uses cookies and web log files to track site usage.  A cookie is a small amount of data, which often includes an anonymous unique identifier, sent to your browser from a website's computers and stored on your computer's hard drive.  One type of cookie, known as a "persistent" cookie, is set once you've logged in to your IndyProfessionals account.  The next time you visit the IndyProfessionals website, the persistent cookie will allow us to recognize you as an existing User so you will not need to log in before using the service.  In order to access or change any of your private information (like a credit card number) or to send a message to another User, however, you must log in securely again with your password even if your computer contains your persistent cookie.  Additionally, if you log out of the IndyProfessionals website you will need to re-enter your password the next time you visit in order to log in to your account.  Another type of cookie, called a "session" cookie, is used to identify a particular visit to the IndyProfessionals website.  Session cookies expire after a short time or when you close your web browser.  We use cookies to improve the quality of our service by storing User preferences and tracking User trends. In the course of serving advertisements or optimizing services to our Users, we may allow authorized third parties to place or recognize a unique cookie on your browser. Any information provided to third parties through such cookies will not be personally identifiable but may provide general segment information, e.g. your industry or geographic location, your occupation, or information about your professional or educational background, for greater customization of your User experience. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent.  IndyProfessionals does not store personally identifiable information in the cookies.  If you would prefer to refuse cookies, turn them off using your browser. It is not required to have cookies turned on in order to use our web site.  However, if your browser is set to reject cookies or you delete cookies, you may not be able to use some features of certain websites.  You can also delete individual cookies or all cookies on your computer by following the browser help file directions.

Web Beacons.
We allow other companies, called ad networks, to serve advertisements to Users.  Ad networks include third party ad servers, ad agencies, ad technology vendors and research firms.  IndyProfessionals may "target" some ads to Users that fit a certain general profile - for example, "television producers in California."  IndyProfessionals does NOT use personally identifiable information to target ads.
To deliver these ads properly, IndyProfessionals may include a file, called a web beacon, from these ad networks within pages served by IndyProfessionals so the networks may provide anonymized, aggregated auditing, research and reporting for advertisers as well as to target ads to you while you visit other websites.
Because your web browser must request these advertisements and web beacons from the ad network's servers, these companies can view, edit or set their own cookies, just as if you had requested a web page from their site.
These general targets may also be used by ad networks to display targeted ads on other websites as a substitute for random, irrelevant ads.  IndyProfessionals does not provide personally identifiable information to any advertiser or any other third party.
You may opt-out of the use of web beacons in IndyProfessionals pages that you view and of placement of a cookie by ad networks in your browser.  To opt-out email advertise@indyprofessionals.com with "Opt-Out of Web Beacons" in the subject line.  If you opt-out you may lose the potential benefit of receiving ads that are more targeted to your interests which, in turn, may limit your ability to fully realize the benefits of the IndyProfessionals services to build and leverage your professional network.

Log files, IP addresses and information about your computer.
Due to the communications standards on the Internet, when you visit the IndyProfessionals web site we automatically receive the URL of the site from which you came and the site to which you are going when you leave IndyProfessionals.  We also receive the Internet protocol (IP) address of your computer (or the proxy server you use to access the World Wide Web), your computer operating system and type of web browser you are using, email patterns, as well as the name of your ISP.  This information is used to analyze overall trends to help us improve the IndyProfessionals service.  The linkage between your IP address and your personally identifiable information is not shared with third-parties without your permission or except when required by law.

Consent to IndyProfessionals Processing Information About You.
Certain information you provide to IndyProfessionals may reveal, or allow others to identify, your nationality, ethnic origin, religion or other aspects of your private life, and more generally about you.  Please be aware that in providing information to IndyProfessionals for the purposes of opening your User account, you are expressly and voluntarily accepting the terms and conditions of this Privacy Policy and IndyProfessionals's User Agreement. The supplying of all such information by you to IndyProfessionals, including all information deemed "sensitive" by applicable law, is entirely voluntary on your part.  You have the right to withdraw your consent at any time, in accordance with the terms of this Privacy Policy and the User Agreement, but please note that your withdrawal of consent will not be retroactive.

Right to Access, Correct and Eliminate Information About You.
You have a right to access, modify, correct and eliminate the data about you which has been collected pursuant to your decision to become a User.  If you update any of your information, we may keep a copy of the information which you originally provided to us in our archives for uses documented herein.

When we may disclose your information to others.
We do not sell, rent, or otherwise provide your personally identifiable information to third parties for marketing purposes.  We will only share your personally identifiable information with third parties to carry out your instructions or to provide specific services or information. For instance, we use a credit card processing company to bill Users for subscription fees.  These third parties do not retain, share, or store any personally identifiable information except to provide these services and they are bound by confidentiality agreements which limit their use of such information.
We may provide aggregated anonymous data about the usage of our services to third parties for such purposes as we deem, in our sole discretion, to be appropriate, including to prospective advertisers on IndyProfessionals.  If you would like to be excluded from the aggregated research or products based upon aggregated data about our Users' activities on the site, please email communications@indyprofessionals.com.
From time to time, and notwithstanding any other provision of this Notice, we may partner with unaffiliated companies or individuals for market research product development or similar purposes.  These companies or individuals may be provided with access to personally identifiable information, but we will require by contract that they agree to maintain the confidentiality, security and integrity of such information.  We also may subcontract with other companies and individuals to do work on our behalf; they may be provided with access to personally identifiable information, but only as needed to perform their functions.  Please be aware that IndyProfessional's advertisers or web sites that have links on our site may collect personally identifiable information about you on their sites.  The information practices of those web sites are not covered by this privacy policy.  In addition, Users and other members may be able to access certain information that you provide to them (e.g. your e-mail address and content that you post on sites that we link to as well as when you publically post such information on your profile and in other sections of our website).  IndyProfessonals is not responsible for monitoring or controlling any particular User's or community member's use of that content.  Notwithstanding any other provision of this Notice, we may disclose personally identifiable information to any third party when disclosure is required by law, or desirable to permit us to exercise or preserve our legal rights or take action regarding potentially illegal activities or to protect the safety of any person.  In the event that IndyProfessionals is acquired by or merged with a third party entity, or in the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected as part of such merger, acquisition, sale, or other change of control.

Discussion Boards/Jobs/Events/Classified
If you post on the Discussion Boards, Jobs, Events or Classifieds sections of IndyProfessionals, you should be aware that any personally identifiable information you choose to provide there can be read, collected, or used by other Users of these forums, as well as other third parties, and could be used to send you unsolicited messages. IndyProfessionals is not responsible for the personally identifiable information you choose to submit.

Accessing and Changing Your Account Information
You can review the personal information you provided us and make any desired changes to the information you publish, or to the settings for your IndyProfessionals account including your email, and contact preferences, at any time by logging in to your account on the IndyProfessionals website.  Please be aware that even after your request for a change is processed, IndyProfessionals may, for a time, retain residual information about you in its backup and/or archival copies of its database.

Closing Your Account
You can also close your account through the IndyProfessionals website.  If you close your IndyProfessionals account, we will remove your name and other personally identifiable information from our publicly viewable database.  We may retain certain data contributed by you if we believe it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally identifiable data, account recovery, or if required by law.  To request that we close your account and remove your information from the IndyProfessionals website, please send your request to communications@indyprofessionals.com.  Please send your request using an email account that you have registered with IndyProfessionals under your name.  You will receive a response to requests sent to communications@indyprofessionals.com within ten business days of its receipt.

Your Obligations
As a User, you have certain obligations toward the other Users with whom you will be communicating.  Certain of these obligations are imposed by applicable law and regulations, and others have become commonplace in User-friendly communities of like-minded members, such as IndyProfessionals:

  • You must, at all times, respect the terms and conditions of the then-current Privacy Policy and the User Agreement.  This includes respecting all intellectual property rights which may belong to third parties (such as photographs and videos).
  • You must not download/upload or otherwise disseminate any information which may be deemed to be injurious, violent, offensive, racist or xenophobic or which may otherwise violate the purpose and spirit of IndyProfessionals and its community of Users.
  • You must not provide information to IndyProfessionals and /or other Users which you believe might be injurious or detrimental to your person, professional or social status.

This is in addition to and in conjunction with our User Agreement.  Any violation of these guidelines may lead to the restriction, suspension or termination of your account by IndyProfessionals.

IndyProfessionals Communications
IndyProfessionals will communicate with you through email and notices posted on the IndyProfessionals website or through other means available through the service.  IndyProfessionals may send you promotional information unless you have opted out of receiving such information.  You can change your e-mail and contact preferences at any time by logging into your 'Account & Settings' and amending your email notification choices. If you wish, you can also opt-out of receiving promotional emails, by sending a request to communications@indprofessionals.com.

Children.
This site is not directed at children under the age of 13 and does not knowingly collect any personally identifiable information from children under the age of 13.  If a parent or guardian believes that this site has collected the personally-identifiable information of a child under the age of 13, please contact communications@indyprofessionals.com and we will use our best efforts to remove the information from our records.

Data storage, transfers and security.
We may store the personal details we hold about you for as long as needed, which may be indefinitely.  We may store this information in the United States or we may transfer it to any other country.  The data protection laws in countries to which personal data are transferred may or may not provide a level of protection equivalent to the laws in your home country.  Wherever we hold the data, we will apply the terms of this Notice and any applicable data protection law.  We maintain certain procedures to protect the confidentiality, security and integrity of personally identifiable information while it is controlled by us.  However, the storage and communication of personal data cannot always be completely secure.  Also, we cannot and do not guarantee that data transferred to third parties in accordance with this Notice will be protected against intentional or accidental misuse or loss.

We may change this Notice and our data collection and management practices.
We reserve the right to update this privacy policy at any time, with or without advanced notice.  In the event there are significant changes to our practices in collecting and handling personally identifiable information we will notify you by means of a notice on our home page or send you an email.  We will also post a prominent notice at this website and indicate at the top of this statement when it was most recently updated.  If, after reading the material changes, you do not want the material changes to apply to your personally-identifiable information you can email us at communications@indyprofessionals.com and request to opt-out, if possible, or alternatively to cancel your User account.
Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account.  If you use the IndyProfessionals service after notice of changes have been published on our site or sent to you, you hereby provide your consent to the changed practices.

Security
In order to secure your personal information, access to your data on IndyProfessionals is password-protected, and sensitive data (such as credit card information) is protected by SSL encryption when it is exchanged between your web browser and the IndyProfessionals web site.  It is your responsibility to protect the security of your login information.  Please note that emails and similar means of communication with other Users of IndyProfessionals are not encrypted and we strongly request you not to communicate any confidential information through these means.
